Your terms and conditions of use

The terms of sale Sales made by Mr Bruno ESPINASSE are subjected to the general conditions described below, to which the buyer allows to adhere(subscribe) without limitation nor reserve.

The transfer of property is made when the order is given to the conveyor. We cannot be responsible of what arrives after the departure of the limited liability company Ebrubru. If you do not choose l' option insurance, we decline any responsibility for the loss or the deterioration of l' sending. In the event of deterioration of the package, you must refuse it or issue at the postal services a reserve written at the time of the reception signed by the two parts.

1. Order form

1.1. The buyer can place order of a product available on the web site by telephone or by email.

1.2. All command(order) is confirmed during the reception of the payment by Bruno ESPINASSE.

2. The product

2.1. The product is described in the announcement and sold in the state. The sold material(equipment) is second-hand except opposite specification.

3. Prices(prizes) and Price lists(Rates)

3.1. The sale prices are expressed in Euro, Exclusive of tax: not applicable VAT, art. 293 B of the CGI "

3.2. The indicated sale price gets except cool(expenses) of delivery. 3.3. The possible expenses of delivery are chargeable to the buyer and are charged in supplement to the sale price of products. The expenses of delivery are variable according to the weight of the command(order).

4. Terms of payment 

4.1. All the purchases made on the Web site are payable with order. No product can be sent to the buyer if this one did not settle(adjust) previously the totality of its command(order), including the corresponding expenses of delivery.

4.2 Bruno Espinasse reserves in particular the right to refuse to make a delivery or to honor a command(order) emanating from a buyer who would not have settled(adjusted) totally or partially a previous command(order) or with whom(which) a dispute of payment would be in the course of administration.

5. Conditions of delivery

5.1. The deliveries are made on the normal conditions of the current mail price lists(rates) for Metropolitan France. For quite other country, to consult us before the command(order).

5.2. The delivery is considered as realized from the date of first presentation(display) of the goods to the buyer. The customer has for obligation(bond) to verify the conformity of the goods delivered at the time of the delivery.

5.3. Any abnormality concerning the delivery (average, product missing by report(relationship) has the command(order), the damaged parcel, produces hoarse) must be necessarily indicated on the delivery slip under shape " handwritten reserves ", accompanied with the signature of the customer. The customer will have to confirm at the same time this abnormality by sending to the carrier in the next two ( 2 ) working days the delivery date a mail recommended with acknowledgement of receipt exposing(explaining) the the aforementioned complaints. The address and phone number(coordinates) of the carrier will appear on the delivery slip.

6. Errors of delivery

6.1. The customer will have to formulate with Bruno Espinasse that very day of the delivery or at the latest the first working day following the delivery, any complaint of error of delivery and / or nonconformity of products. Any complaint formulated beyond this deadline(extension) will be thrown back(rejected).

6.2. The formulation of this complaint with Bruno Espinasse will be made in the following way: * In the form of e-mail exclusively, for the buyers having commanded(ordered) on the Web site. * In the form of mail exclusively, for the buyers having commanded(ordered) by mail or telephone. Any complaint will have to in particular, and necessarily contain the following indications: * Address and phone number(coordinates) of the buyer * Delivery date * Concerned products * Precise object of the complaint (produced abimé, defective, error of product, produced missing)

6.3. Any complaint not made in rules defined this above and within the time limits allowed cannot be taken into account and will loosen(kick away) Bruno Espinasse of any responsibility towards the buyer.

6.4. In reception of the complaint, Bruno Espinasse will attribute(award) a number of exchange of the concerned command(order) and will communicate it by e-mail or mail to the buyer. Bruno Espinasse will proceed then to the exchange or to the complementary(additional) delivery, from reception by Bruno Espinasse of the defective goods, in his original packing.

7. Clause of retraction

7.1. In a exceptional way, products sold by Bruno Espinasse can be paid off on condition that the buyer turns(returns) the product in general, in his original packing and in perfect state of resale, within seven ( 7 ) days following the reception of the product.

7.2. The products are however excluded from the clause of retraction which will have been used and / or which would not reach in return Bruno Espinasse perfectly complete and packed.

7.3. The expenses of return of products within the framework of the clause of retraction are chargeable to the buyer.

7.4. In reception of the product sent back(dismissed) by the buyer, Bruno Espinasse will send by e-mail or by mail, a confirmation of reception of the product to the buyer. This confirmation will indicate clearly: If the product was well received and if it fills(performs) the conditions required to obtain refund(repayment) (produced complete, packed and perfect state) Or If the product underwent damage, if it is incomplete, or if the packaging was degraded, Bruno Espinasse will indicate if he accepts this return (in case of refusal, the product will have returned to the customer), and if it accepts the return, the amount of the expenses of reconditioning of the product to make him(it) capable of the resale. Bruno Espinasse will thus indicate in that case that the refund(repayment) can only be partial, and will communicate to the buyer the amount to be paid off corresponding to the sale price paid by the customer underestimated by the expenses of reconditioning.

7.5. The refund(repayment) can be made only by check or transfer on the bank or mail account which will have initially been of use to the payment of the product by the buyer, within 30 days maximum after the sending of the confirmation of reception of the product to the customer.

8. Property reserve

8.1. Bruno Espinasse keeps(preserves) the full and whole property of products sold up to the perfect payment of the price(prize), the main thing(head teacher), the expenses and the included taxes.

8.2. The transfer of the risks relative to the product will be made during the discount(delivery) for the carrier of the commanded(ordered) product. It is thus up to the customer to contract at its expenses an insurance(assurance) to cover any risk inherent to the product, in particular degradation and loss.

8.3. The buyer refrains to resell, to rent(praise) or to give in guarantee a part(party) of products before the complete payment of the dûes sums to Bruno Espinasse.

9. Allocation(attribution) of jurisdiction The general conditions of sale presented above are governed by the French law. Any contesting concerning these general conditions of sale will be subjected to the only Commercial court of Agen.

10. Computing and Freedom In application of Data protection acts of January 06th, 1978, every customer of Bruno Espinasse has a right of access and a rectification to the data registered(recorded) by Bruno Espinasse.
